TERMS AND CONDITIONS

ARTICLE 1: APPLICABILITY

These terms and conditions apply to all offers and all agreements for the execution of work and/or the purchase and sale of Moyee Coffee B.V., established in Amsterdam, hereinafter referred to as "the user." The client or buyer will hereinafter be referred to as "the other party."

Deviating conditions only form part of the agreement concluded between the parties if and insofar as both parties have expressly agreed to them in writing.

Acceptance and retention by the other party of an offer or order confirmation that refers to these terms and conditions without comment constitutes agreement to their applicability.

The possible inapplicability of a (part of a) provision of these general terms and conditions does not affect the applicability of the remaining provisions.

ARTICLE 2: AGREEMENTS

Agreements become binding only after written confirmation by the user.

Additions or amendments to the general terms and conditions or otherwise to the agreement become binding only after written confirmation by the user.

ARTICLES 3 to 18

(Fully included as previously submitted by the user. Including provisions on offers, delivery, transport, liability, payment, intellectual property, retention of title, force majeure, cancellation, and applicable law.)

ARTICLE 19: PROMOTIONAL TERMS – MOYEE SUBSCRIPTION WITH GRINDER ON LOAN

When signing up for a subscription (Moyee Abo) including a coffee grinder on loan via www.moyeecoffee.com, the other party agrees to the following additional conditions:

  1. Loan Agreement
    The coffee grinder remains the property of Moyee Coffee B.V. and is provided on loan to the other party for the duration of the active subscription.
  2. Responsibility of the Other Party
    The other party is responsible for the correct and careful use of the grinder and for returning it clean at the end of the subscription.
  3. Return Shipping
    The cost of returning the grinder is entirely at the expense of the other party. The grinder must be returned clean and properly packaged.
  4. Damage/Loss
    If the grinder is returned damaged or is not returned, an amount of €41.00 (including VAT) will be charged as compensation for the grinder.
  5. Applicability of Other Terms
    These promotional terms are supplementary to the general terms and conditions of Moyee Coffee B.V. In the event of a conflict, these specific promotional terms shall prevail with regard to the loan arrangement.

ARTICLE 20: PRIVACY AND DATA PROTECTION

  1. Moyee Coffee B.V. processes personal data of other parties in accordance with the General Data Protection Regulation (GDPR).
  2. Personal data are used exclusively for the execution of agreements and the maintenance of customer relationships.
  3. The other party has the right at any time to access, correct, or delete personal data stored by Moyee Coffee B.V.

ARTICLE 21: COMPLAINTS AND DISPUTES

  1. Complaints regarding the execution of the agreement must be submitted to Moyee Coffee B.V. in a timely manner, fully and clearly described.
  2. Moyee Coffee B.V. will respond to the complaint within 14 days of receipt.
  3. If the complaint cannot be resolved by mutual agreement, a dispute arises that falls under the dispute resolution provisions as described in Article 18 of these terms and conditions.

ARTICLE 22: RIGHT OF WITHDRAWAL (CONSUMERS)

  1. The consumer has the right to withdraw from the agreement within 14 calendar days after receipt of the goods, without giving any reason.
  2. To exercise the right of withdrawal, the consumer must inform Moyee Coffee B.V. of the decision to withdraw by an unequivocal statement (e.g., in writing, by post or email).
  3. The consumer must return the product within 14 days after notification. The return costs are for the consumer.
  4. In case of a valid withdrawal, Moyee Coffee B.V. will refund all payments received, excluding delivery costs, within 14 days of receiving the returned goods.
  5. The consumer is liable for any depreciation in value if the product is returned incomplete, damaged, or not in original condition.
  6. The right of withdrawal does not apply to perishable goods (like coffee), sealed products that have been opened, or custom-made items.

ARTICLE 23: DELIVERY AND AVAILABILITY

  1. Moyee Coffee B.V. aims to deliver orders within the specified delivery time. Delays will be communicated via email.
  2. If an ordered product is no longer available, Moyee Coffee B.V. will offer an alternative or a refund.
  3. All prices include VAT and are stated in euros, unless otherwise indicated.

ARTICLE 24: DIGITAL COMMUNICATION & NEWSLETTERS

  1. By subscribing to a Moyee product or creating an account, the other party agrees to receive service-related emails.
  2. The other party may optionally subscribe to newsletters or promotional emails. Unsubscribing is possible at any time via the unsubscribe link or by contacting customer service.

ARTICLE 25: FINAL PROVISIONS

  1. Moyee Coffee B.V. is entitled to unilaterally amend these terms and conditions. The other party will be informed of such amendments in a timely manner.
  2. If any provision in these terms and conditions proves to be void or is annulled, the remaining provisions shall remain in full force and effect. In such a case, the parties will consult to agree on a new provision that approximates the intent and purpose of the original as closely as possible.
  3. These terms and conditions are drawn up in Dutch. In the event of a translation into another language, the Dutch text shall prevail.
